the freedoms guaranteed to all americans by the bill of rights. gun right backers designated january 19 gun appreciation day. for supporters to visit gun shows, shops and shooting ranges and send a message to the president two days before the inauguration. gun control groups are launching a full-blown campaign push with rally and tv ads. tern general eric holder suggested how a gun control media blitz should be run this way in the '90s. >> it's not enough to have a catchy ad on monday and do it every monday. we need to do this every day of the week. and just really brainwash people to thinking about guns and in a vastly different way. >> biden confirmed he will not wait until the end of the month but will present recommendation to president tuesday. as obama's second term gets underway. that he are expected to have background check without exception. >> universal background chec checks. not just close the gun show loophole but universal

the second amendment and the right to bear arms. tomorrow is about the first amendment, free speech. >> bret: student at rural high school used a shotgun when he fired on two other opportunities. it happened this morning at taft union high school 120 miles northwest of los angeles. one student was wounded. listed in critical, but stable condition now. the shooter missed the other student. teacher sustained a minor pellet wound. the gunman was taken in to custody. california has the toughest firearm laws in the country. tonight, claudia cowen shows us how difficult is it to legally arm yourself in the golden state. >> buying a handgun in california is no simple task. it requires registration, a safety certificate. ten-day waiting period and rigorous background check. direct person to person sales are banned and concealed carry permits are rare. the state routinely redefines

to another deeply divisive subject: how to handle the u.s. economy. at a time when the fiscal difference split the country, the president's pick to be the new treasury secretary is sparking harsh reaction from some on capitol hill. correspondent shannon bream on the nomination of jack lew. >> i cannot think of a better person to continue tim's work at treasury than jack lew. >> reporter: president obama nominating a new man to head the treasury department but signaling plans to continue with the fiscal policy the administration relied on in the first term. white house says lew has a keen understanding of domestic and international issues that impact the u.s. economy and point to the track record. >> under president clinton he presided over three budget surpluses in a row. with the talk of deficit reduction, making sure the boog are balanced this is the guy who did it. three times. >> reporter: republican opponent, senator jef sessions chief among them say

jack lew is the wrong man for the job and without then house speaker newt gingrich refusing to allow more government spending the budget achievements would never have happened. sessions without qualification, accuses lew of lying to congress when testifying about the president's fiscal policy and plans. >> he is consistently and deliberately misrepresented the facts of the president's plan. as the budget director for the president. >> reporter: in his book "the price of politics" bob woodward asserts that lew had a key role in putting together the sequester plan. temporarily delayed for a few weeks will unleash across the board domestic cuts if congress doesn't agree on a plan to cut spending. they deny that the sequester idea originated from him. pinning it on congress. here is how jay carney responded to suggestions that the ideas frame the white house. >> i don't know where the idea came out of. >> democrats quickly endorsed the president's pick today. house minority leader nancy pelosi calling him a public

service of dignity and commitment to spur economic growth. harry reid said lew is outstanding choice and joined the call for prompt confirmation. >> it will be a test for the senate. should we confirm someone for the important office who deliberately misrepresented the facts in the area of his expertise the budget when he testified before the senate? >> independent senator bernie sanders says he will not vote for lew and said he is concerned that the president had so many key economic advisors with ties to wall street. he says he would rather see someone heading to treasury who would stand up to corporate america. >> bret: shannon bream live on the north lawn. thank you. now for some analysis on the lew nomination, joined by senior political analyst brit hume. good evening. >> my, bret. senate republicans as you just heard objectbe to jack lew because they think he failed to tell them the truth in the past. it will be interesting to see if he tells it this time.

especially about taxes. budget director, lew well knows the amount of money available from taxing rich people is nowhere near enough to pay for the swelling cost of entitlement programs now about 60% or so of the federal spending. since the president shows no interest in reforming the programs the only way to come close to financing them is to sock the middle class with higher taxes. much higher. mr. lew's problem is mr. obama has shown no interest in doing that either. many suspect sooner or later he will? witness the recent fiscal cliff association. higher income taxes on all taxpayers set by law to take effect january 1. mr. obama never considered letting it happen agreeing to let them rise on the 1%. although he let a two-year cut in social security payroll taxes expire as scheduled. weak growth is lower tax receipt. given the liberal views mr. lew and the president left themselves no good option for

dealing with the dilemmas. mr. lew could make a start by telling the truth about taxes. but will he? bret? >> bret: brit, we talked about it before about the word "default" tossed around when talking about the debt ceilin ceiling. why do you think that the word is being kind of loosely used in this framework? >> default traditionally understood means failure to make payment on your debt. on your national debt. those payments account for 6% of the federal spending. tax receipt which would continue after a breach of the debt ceiling account for 60%. so they would overwhelmingly be plenty of money to make payment on the national debt. you will hear default on our obligations. that is a loose and slippery term which means that the government wouldn't be able to finance all of the spending. it would be a bad outcome. it would not be traditional understood. >> bret: the government would have to close things? >> significant piece of the

government. program would shut down and people would be furloughed and so on. not default on the national debt. >> bret: important distinction. brit, thank you. >> you bet. >> bret: defense secretary leon panetta says he has directed the military to begin taking prudent steps to offset impact of huge budget cuts scheduled for march 1. he said he directed the services to begin planning now in case he has to put nearly 800,000 civilian employees on unpaid leave for up to a month during the remainder of the fiscal year. mortgage rates are ticking up a bit from record lows. freddie mac says the average interest on 30-year fixed loan is 3.4%. up from 3.34% last week. stocks finished in positive territory today. the dow gained 81. the s&p 500 was up 11. nasdaq rose 16. here at home, there could be a quirky consequence to jack lew as new treasury secretary. we'll show you what that is later in the grapevine. up next no, tea party in boston. as flu hammers the bay state.

administration continues to insist to push the failed solution to the pressing problems. we will not allow law-abiding gun owners to be blamed for act of criminals and mad men. >> bret: one of the things that sparked concern is possible executive actions. what could possibly the exective actions be? a list of us. bolster the background check system. require gun dealers for increase security and illegal sales and those are things that the white house could do without the congressional approval. bring in the panel. judge andrew napolitano, fox news senior judicial analyst. mara liasson of the national public radio and syndicated columnist charles krauthammer. judge, i read your piece on

foxnews.com. i know where you are going to come down on this. your thoughts on the task force and what we are seeing develop here. >> i am so disappointed but not surprised at the task force. it is a group with a predetermined end. the end result is to find the way to limit the right to keep and bear arms. they are going through the machinations to make it look like they are fair and considering all sides. i am also disappointed in the existence of the task force. the statement that vice president biden just said, that you just ran said i'm going to try to remember it and paraphrase it, this is a complicated issue. how do we deal with the problems in newtown and problem in aurora? that is not the job of the federal government. the federal government's job is not to keep us safe. it's to keep us free, preserve our freedoms and keep us safe from the foreign enemies. the job of the state of connecticut to deal with it and the job of the state of colorado to deal with it. unless they want to amend the constitution it's not the job of the federal government. these guys don't get that. this administration believes it can right any wrong and

regulate any behavior and candidly trample any guaranteed right in the name of safety, and fulfilling the perceived popular will. >> bret: this statement by the nra clearly a firm push back here. you are seeing the grass roots effort including effort on january 19 to gun ownership day essentially. appreciation day. mara, how do you think this is playing out and where it falls? >> i think in the past, secretary amendment groups have really -- second amendment groups had the upper hand in the debate. it's impossible to pass gun restrictions through congress. it still is. but you see groups like the new one formed by gabrielle giffords or michael bloomberg who has money to put behind it. they want to be counterweight for the nra. it will take a long time to do that. the public is willing to see some more gun restrictions like background checks, maybe a been a of high capacity magazines.

but the reason the president and the vice president talk about the executive orders that can't do that much is because they understand how difficult it will be to get the legislation of any type passed through this congress. he can bolster the data collection and ban import of assault weapons but not much else he can do by himself. >> bret: look, the polls. recent poll, the quinnipiac poll if virginia. and they asked do you favor background checks at gun sho shows? 92% favor that. 7% oppose. this is registered virginia voters. obviously, virginia is a state that democrats passed election. and a pretty fair assessment. split. other question do you favor putting armed police officers in public schools? 66% favor. 29% oppose. actually when you broke it

down it was 7 #% republicanssh -- 79% republicans and 58% democrats favored. nra supported position of putting armed guards in schoo schools. >> the country is split on many issues but in the end what mara is saying is correct. it's not going to make much difference. i would be impolite to say the measures are placebos. as a doctor i did sustained placebos. it doesn't hurt anybody. just feel better. it's cheap and a sugar pill. we had a fairly restrictive assault weapons ban in the mid- '90s. it lasted ten years and it had almost zero effect on the violence. gun violence. and these measures will have zero effect on the massacres as we saw in aurora or tucson. people will have the feeling they have done something.

but here is the reason why the ban failed in the mid-'90s. it wasn't the loopholes and the way to get around the law. the fact is there are 300 million guns in america today. unless you take them away, which you can't under our constitution, the second amendment, you can prevent the new sales or imports or whatever. they will be around for a hundred years. therefore, you get no essential result when you do the bans, unless you want to repeal the second amendment. that i think is a tark truth. if we had an honest debate, the gun control advocates would say repeal the second amendment. and we'd have debate on that. we can't have an honest debate because you get nowhere arguing to have a repeal of the second amendment. so we have arguments about placebos. >> bret: judge, in each one of the task force meetings, to the vice president's right, attorney general eric holder. he has been advocate of doing

something on guns. for a long time. here is how he phrased it back in the 1995. about the importance of this. >> what we need to do is change the way in which people think about guns, especially young people. and make it something that is not cool, that is not acceptable, not hip to carry autobahn anymore. the way in which we changed the attitude about cigarettes. when i was growing up people smoked all the time. i mean both my parents did. over time, we changed the way in which people thought about spoking. and s -- smoking so now we have people cowering outside of building that smoke in private and don't want to admit it. >> bret: he went on to say we should start to "brainwash" people about guns. do you think that this administration wants to go beyond magazines or what they are talking about with the regulations? this is the fear from folks

who fear this is the first step in a series of things. do you think from these statements and other statements that there is more that the administration wants to do? >> yes, i share that fear, which is why i keep waving the flags in things i have written about. you were kind enough to mention the piece today. there is no section of the constitution clearer than the second amendment. right of the people to bear arms should not be infringed. that means all the people and by any government. supreme court just ruled on this twice in five years. both times it said this amendment is protecting a natural right coming from our manity. extension of the right to self-defense. that is the, that is what they took oath to uphold. the attitude, the president, the attorney general and vice president. folks that work with them is we have to find some way, any way to diminish the rate to keep and bear arms because they believe they belong to a school of thought that believes the government can protect us better than we can protect ourselves and we

gender blind. >> it looks as if the binder of women that obama ordered up was extremely thin or empty when he got it. look, there is only one point you should make on this. which is the obvious hypocrisy of the democrats who pretend they were the tribute of women against nasty republicans. who are making a war on women. and romney who would have posted policeman in front of pharmacies that would prevent any woman from getting a contraceptive. so, it's a matter of hypocrisy. on the principle, the republicans and conservatives should never counter by race or gender. it's against what our country is and the sooner it's apolished and the sooner people notice the healthier our country will be. >> bret: last word, does he get everybody in? >> that is a good question. in the end he does. i think hagel is a big knock-down drag-out fight but in end he gets through, too. he is the only one that has a
